That amendment was ratified in 1870 under the administration of President Grant, one of my heroes. Mr. Matthews goes on to list some of the ways that states have tried to suppress the right to vote for non-whites. He closes by reminding Justice Scalia that the right to vote is indeed a right and not a benefit, like Food Stamps or Medicare.
