After reviewing the footage you've provided with Senior Sergeant Hxxxxx the other vehicle registration DNT1 was seen to remain within its lane and as a result has not committed any offence. It is also noted that you appear to more [sic] forward and left towards the path of the other vehicle putting yourself at risk. As a result your complaint has not been substantiated. In the future please be more cautious in relation to your own safety when riding your bicycle on the road. There will be no further Police [sic] action in relation to this complaint. This file has now been forwarded to the Wellington Records Office for Filing [sic]. If you have any queries please direct them to myself on DDI 802 xxxx. Yours faithfully Constable Pxxxxxxx ### ----- And my statement to the police ----- I was travelling by bicycle north on Wellington Rd between Crawford St and Ruahine St. I was turning right onto Wellington Rd. The driver of a black Nissan Micra stopped and waved me into the intersection, after first waving the car ahead of me into the intersection. While waiting to complete the turn onto Wellington Rd (towards Kilbirnie Cr) I was maintaining an assertive lane position (as advised in the NZTA Road Code) and was approached from behind by a red Toyota mini-van DNT1. The driver appeared to be a heavyset female of Maori or Pacific Island descent. I noticed that this vehicle was mostly outside of the marked lane (mostly within the painted traffic island), but drivers sometimes squeeze behind me into that area; at the time I was not concerned by this, and pulled forward to allow DNT1 to be clear of the northbound lane. When there was an opportunity to safely proceed onto Wellington Rd (towards Kilbirnie Cr) DNT1 quickly cut around and in front of me, causing me to go from stopped, to moving, to stopping; almost all at the same time. DNT1 came around me with no warning and passed within 20-30cm of my bicycle. It is clear in the helmet-cam video (watching the steering wheel) that the driver was "cutting me up" and not allowing any room for me. Had I not stopped in time this would have certainly resulted in a collision. Rather than race out alongside of DNT1 I came to a stop and waited for another opportunity to safely proceed onto Wellington Rd. It is my intent to pursue prosecution against the driver of DNT1 to the fullest extent of the law. This shocking example of inconsiderate and impatient driving is inherently dangerous. I would be quite happy if they are charged under Section 7 or 8 of the Land Transport Act, or Section 2.3, 2.6, or 2.8 of the Land Transport (Road User) Rule 2004. Ultimately, I trust that the investigating officer will determine an appropriate charge based on all available evidence. "At intersections, apply the same rules to cyclists that you would to any other vehicle on the road." - NZTA, Sharing the road with cyclists At the time of the incident I was employing hi-viz clothing and accessories, two rear lights (and a front light) which are clearly visible in daylight, bright yellow pannier bags, etc, and the street was illuminated by strong clear sunshine.
